I was found not access RESP for a car. His fam sue me in civil court for 7mill. How can they do that?
The accident I just happened by turning left onto my street. The man hit my passenger side, he died shortly afterwards on places. There were many witnesses, and they say that the bike trail was racing with another vehicle, whose speed in the 80's. Road speedlimit is 40 mph. When I was turnig I realized that these drivers were so fast, by the way, the driver of the car others fled the scene, nobody had the number plate. We knew what the make, model and color of the other vehicle was. Now, his ex-wife was the executor of his estate, she invites everyone to 1mill her 2 children, then the balance, I will assume kept in a trust. How can they sue me if I found not responsible, not even a ticket. I do not understand what civil court. My lawyer even told me that we could not tell the court I was found completely free of any wrongdoing ... Please help me understand this
This is a civil, not criminal. The justice system allows the recovery, punitive damages, and compensation grant, although some was found innocent of criminal wrongdoing. Its place to the jury.
